Jaimee AI privacy policy

Digital J Pty Ltd (ACN 681 302 312) (we, us or our) (who operates Jaimee.AI) understands that protecting your personal information is important. We want to explain how we handle your personal information. This policy is about protecting your privacy when you use our AI services. 

If you are an individual in the European Union or European Economic Area (EU), you may also have rights under the General Data Protection Regulation 2016/679. If you are located in the United Kingdom (UK), you may have rights under the General Data Protection Regulation (EU) 2016/679) (EU GDPR) and the Data Protection Act 2018 (DPA 2018) (together, the GDPR). Please look at Appendix 1 which provides information on these additional rights. It also has information on how we process the personal information if you are located in the EU and UK.

What information do we collect? 

We collect different types of personal information about you, including: : 

  • Basic information: Your first or preferred name as you input into the AI Chatbot, or your full name (if you choose to provide it) and age   

  • Contact Data : Your email address

  • Payment information: Your card details, not held by us but only provided to the third-party payment provider i.e. Google Play and Apple App Store so you can make payment (but we don’t store these ourselves – Google Play and Apple App Store handle payments for us). 

  • How you use our service: What you do on our platform and your chat records. 

  • Memory data: key facts you share during chats (such as names of your family members, your interests, or significant life events) which we extract and store to enhance future conversations. 

  • Technical information: Information about your device and how you use our platform. 

  • Your account: Your username and password. 

  • Your activities: Things you post, share, or ask for help with. 

  • Your marketing preferences: How you want us to contact you. 

  • Sensitive information: You may or may not divulge sensitive information as part of your chat with Jaimee, our AI Chatbot. This could include things like your race, political views, religion, or health information. Where you do, we will store this along with the rest of your chat history. The information may be used by out AI Chatbot to inform Jaimee’s chat output (you can read more about this in the ‘Use of Artificial Intelligence’ section). We only collect this if you choose to share it with us. We only collect, hold, and use sensitive information: 

  • with your consent; 

  • for providing and improving our AI Chatbot; 

  • a secondary reason that is directly related to providing and improving our AI Chatbot, including disclosure to third parties as necessary to do business with you; and 

  • as we are required to by law. 

How do we get this information? 

We collect information in a few ways: 

  • when you give it to us directly via our app (either during onboarding process or during chat exchanges with Jaimee); 

  • when you fill out forms on our website; and 

  • when you use our app or website (through cookies and other tech tools). 

Why do we collect and use your information?

We use your information to: 

  • facilitate your use of our AI service including Jaimee, our AI Chatbot (i.e. lets you have a conversation with Jaimee); 

  • communicate with you and answer your questions; 

  • keep track of payments and billing;  

  • improve our service;  

  • comply with our legal obligations; 

  • train and improve our AI model to help improve the overall quality of chat interactions, as Jaimee learns from the data. If you do not want us to use your chat data to train the model, please contact us at privacy-officer@jaimee.ai, and we will ensure that your chat data is excluded from this process.  

Who do we share your information with? 

We might share your information with: 

  • our employees and contractors and/or related entities (for example, we give access to small samples of user data to our employed data scientists, and may give this access to data scientists working on contract for us, for the purpose of checking that our AI model is working and the output is as expected); 

  • companies that help us run our service (like IT providers) (for example, cloud data storage providers, where we host our data and technology, and cloud software platforms we use as part of our technology solution); 

  • advertising and marketing companies (for example email services providers for the purposes of sending emails to users); 

  • professional advisors (like lawyers or accountants) (for example where they provide us advice about running our AI Chatbot or for compliance or auditing purposes); 

  • our existing or potential agents or business partners (excluding selling your personal information to third parties); 

  • if our company joins with another company or is sold, we might need to share your information with the new owners; 

  • third parties to collect and process data, such as analytics providers and cookies and 

  • courts or law enforcement if required by law. 

We won’t sell your personal information to other companies. 

Sensitive information: We will only disclose sensitive information with your consent or where permitted by law. This means that we may disclose sensitive information to: 

  • our employees and contractors and/or related entities (for example, we give access to small samples of user data to our employed data scientists, and may give this access to data scientists working on contract for us, for the purpose of checking that our AI model is working and the output is as expected); 

  • companies that help us run our service (like IT providers); (for example, cloud data storage providers, where we host our data and technology, and cloud software platforms we use as part of our technology solution) 

  • professional advisors (like lawyers or accountants) (for example where they provide us advice about running our AI Chatbot or for compliance or auditing purposes);; 

  • if our company joins with another company or is sold, we might need to share your information with the new owners; 

  • third parties to collect and process data, such as analytics and cookies and 

  • courts or law enforcement if required by law. 

Google Analytics:  

We may use a tool called Google Analytics to understand how people use our website. This tool uses small files called “cookies” to collect information about how you interact with our site and our app. 

Google might also use this information to show you ads on other websites. But don’t worry, you have control over this. If you don’t want Google Analytics to collect your information, you can download a tool from Google to stop it here,. You can also tell Google not to show you personalized ads. There’s a page on Google’s website where you can change these settings here. If you don’t want Google to provide personalised ads at all, even when cookies are deleted from your browser, you can install a tool here.  

To opt out of interest-based ads on your phone: 

  • If you have an Android, go to the Google Settings app and look for “Ads” to change your preferences. 

  • If you have an iPhone, go to your phone’s Settings and look for options about limiting ad tracking.

Where is your information stored? 

We might store your information in other countries than Australia, like the United States or the United Kingdom. We’ll always try to keep it safe, no matter where it’s stored. We have legal obligations to keep it safe. 

Where you are a New Zealand resident, we only share your information overseas if: 

  • you consent after we explain the risks (noting that if you do not consent, you will not be able to access the AI Chatbot); 

  • the other company follows privacy rules that are comparable to New Zealand’s privacy rules. 

Your rights and choices 

You have the right to: 

  • choose not to give us your information (but this might limit how you can use our service); 

  • ask to see what information we have about you (but a fee might be payable); 

  • ask us to correct any wrong information; 

  • ask us to delete your information; 

  • delete all your personal data, chat data, any memory data (key data from your chat we have stored for the AI’s memory), and your account from within the Jaimee app by going to the profile section in the Jaimee app and selecting ‘Delete account’. This will immediately delete your account and all associated data, including your chat data and any responses made by Jaimee in the chat. Your chat data may have been used in training data to improve our AI model. This is to enhance the overall quality of chat interactions, as the AI learns from the data. If you do NOT want us to use your chat data to train the model, please contact us at privacy-officer@jaimee.ai, and we will ensure that your chat data is excluded from this process. We can ensure that your chat data is excluded from this process ongoing (however, if you have already submitted data to the app, we cannot extract that historic data from the training data); 

  • stop receiving marketing emails from us; and 

  • make a complaint if you’re not happy with how we’ve handled your information.  

For Australia and New Zealand residents, if you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (if you are an Australian resident), or the Office of the New Zealand Privacy Commissioner (if you are a New Zealand resident). 

Keeping your information safe 

We work hard to protect your information using secure computer systems. But remember, sending information over the internet is never 100% secure. 

Cookies  and tracking

We use cookies (small files stored on your device) on our website to remember your preferences and show you relevant ads. In our app, we track user actions such as what features you use and how you navigate the app, and we may use unique device identifiers or mobile advertising IDs to personalize content and ads. You can block cookies in your browser settings and you can block mobile advertising by adjusting the privacy settings on your mobile phone as per below. Disabling these features could affect how our website and app work. 

To opt out of interest-based ads on your phone: 

• If you have an Android, go to the Google Settings app and look for “Ads” to change your preferences. 

• If you have an iPhone, go to your phone’s Settings and look for options about limiting ad tracking. 

Links to other websites 

Our website may contain links to other websites. We’re not responsible for how they handle your information, so check their privacy policies too. 

Location data

If you use our mobile app, we might collect your location to help our AI service work better. You can turn this off in your app phone settings. 

Use of Artificial Intelligence 

We use artificial intelligence (AI) to help us run our business and provide our services.  

We might use AI to: 

  • analyse information; 

  • create and change content; 

  • make our services better; 

  • personalise your experience; and 

  • help answer your questions; and 

  • extract and store key information and from your conversations to improve future interactions with the AI Chatbot, allowing the AI Chatbot to provide more personalised and contextually relevant responses in future conversations.  

When we use AI with your personal information, you still have all the same rights over your information as mentioned earlier in this policy. 

To make sure we're using AI responsibly: 

  • we train our staff to understand AI's limits;  

  • we regularly test the AI to make sure that guardrails we put in place to protect users are working; 

  • we have security measures to protect your information; and 

  • we constantly test how the AI is working to identify any issues so we can address them quickly. 

When you input information into the AI Chatbot, it might be used to train the AI system to work better as detailed in this policy. 

Remember, we're always working to use AI in a way that's helpful and respects your privacy. 

Changes to this policy 

We might update this policy sometimes. We’ll post any changes on our website, so please check back now and then.

APPENDIX 1: ADDITIONAL RIGHTS AND INFORMATION FOR INDIVIDUALS LOCATED IN THE EU OR UK 

If you live in the European Union (EU) or United Kingdom (UK), you have extra rights over your personal information. In these places, they often call it “personal data.” This means any information that can identify you. We’ll explain your additional rights and how we handle your information in the sections below. These rules are on top of our main Privacy Policy, so please read both. If you have any questions, you can contact us using the details at the end of our main Privacy Policy. We’re here to help you understand how we protect your information. 

What personal information is relevant?  

This Appendix applies to the personal information set out in the Privacy Policy above. This includes any Sensitive Information also listed in the Privacy Policy above which is known as ‘special categories of data’ under the GDPR. 

Purposes and legal bases for processing 

We only collect and use your personal information when the law allows us to. Here’s a quick summary: 

  • We use your information for different reasons, like providing our service, improving our products, or sending you updates if you’ve asked for them. 

  • We have different legal reasons for using your information. Sometimes we need it to provide our service, sometimes because you’ve given us permission, and sometimes because it helps us run our business better.

If you’ve told us we can use your information for something, you can change your mind at any time. Just remember, we can’t undo anything we’ve already done with your information before you changed your mind. 

Sometimes we use your information because it helps our business or someone we work with. If you don’t want us to use your information for these reasons, you can tell us to stop. But keep in mind, this might mean we can’t provide our service to you anymore. 

You have other rights about your information too. We’ll explain these in more detail later in this policy. 

Data Transfers  

Sometimes we need to send your information to other countries (for example some of the servers that host our service might be in a different country, or we might use an email service provider in a different country). These countries might have different privacy rules than your country. When we do this, we follow special rules to keep your information safe. This might mean: 

  • only sending information to countries that have good privacy protection laws; and  

  • making agreements with the companies we send your information to. 

Data retention 

We only keep your information for as long as we need it (unless you have asked us to delete it). This depends on why we collected it and if there are any laws that say we must keep it. 

We might keep your information longer if someone makes a complaint or if we think there might be a legal issue. When deciding how long to keep your information, we think about what kind of information it is and how risky it would be if someone used it without permission. We also consider why we need it and if we can do what we need to without keeping your information. Of course, we always follow what the law says we must do. 

We always try to keep your information for the shortest time possible while still following the rules, respecting your data deletion requests where we can, and doing what we need to do. Our goal is to balance our needs with protecting your privacy. 

Extra rights for EU and UK individuals 

You can ask us what information we have about you and how we’re using it. This is sometimes called a “data subject request.” You also have other rights under privacy laws. You can ask us to fix any mistakes in your information or to delete it. You can also ask us to limit how we use your information. 

If we’re making important decisions about you using computers instead of people, you might have the right to object to this. You can also stop us from sharing your information with others if we don’t have permission. In some cases, you can even ask us to send your information to you or to another company. 

We want to make sure you understand your rights and can use them. If you want to do any of these things, just let us know, and we’ll help you. 

If you are not happy with how we are processing your personal information, you have the right to make a complaint at any time to the relevant Data Protection Authority based on where you live. We would, however, appreciate the chance to deal with your concerns before you approach the Data Protection Authority, so please contact us in the first instance using the details set out above in our Privacy Policy above. 

APPENDIX 2: ADDITIONAL RIGHTS AND INFORMATION FOR INDIVIDUALS LOCATED IN THE UNITED STATES OF AMERICA 

This Appendix 2 sets out the additional rights we give to individuals located in the United States of America, as well as information on how we process the personal information of individuals located in the United States of America.

Online Privacy of Children     

The Children’s Online Privacy Protection Act (COPPA) requires online service providers to obtain parental consent prior to us knowingly collecting or soliciting personal information from a child under the age of 13. The Jaimee app is not intended for use by children under the age of 13 (it is rated 18+ in Google Play and 17+ in the Apple App Store), and we do not knowingly collect personal information from children under the age of 13 online. If you believe that we might have any information about a child under the age of 13, please contact us at the email address set out at the end of this Privacy Policy.    

Your California Privacy Rights 

Extra Rights for California Residents: If you are a California resident, in addition to the rights set out in our Privacy Policy, you can request to: (a) have your personal information deleted (to the extent permitted by law), which may impact your ability to use our website or our services; (b) opt-out of the sale of your personal information (although please note that we do not sell your personal information) or sharing of your personal information for cross-context behavioural advertising, or by using the ‘Global Privacy Control’; (c) ask that we limit our use and disclosure of your sensitive information to certain purposes permitted by law; and (d) have an authorised agent make requests on your behalf. We will not discriminate against you for exercising your rights, nor will we deny you access to our services, charge different prices, provide a different level of service, or suggest that any of those things might occur if you exercise your rights.    

‘Shine the Light’ Law: Californian residents have a right under section 1798.83 of the California Civil Code to request details about the personal information that we have shared with third parties, and who those third parties are. Californian residents who would like to make a request for this notice can do so by contacting us through the email address set out at the end of this Privacy Policy. Please include your full name and postal address in your email so that we can verify your residency in California and respond. 

Other Privacy Rights    

Please note that we do not sell your personal information.  

Residents in other States (including Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Nevada, Oregon, Texas, Utah and Virginia) may have additional rights under state law, including the right to: (a) request access to their personal information; (b) delete their personal information; (c) correct their personal information); (d) opt out of the processing of their personal information for the purposes of targeted advertising; or (e) opt out of the sale of their personal information (although please note that we do not sell your personal information).  

You may use an authorized agent to submit a request to opt out of targeted advertising or the sale of personal data (although please note that we do not sell your personal information). Authorized agents may submit such requests to the email address set out at the end of this Privacy Policy, provided that we have been given a verification of your identity and confirmation that you provided the agent with authority to act on your behalf.
